By accessing or using PhotoBomb (the “Service”), you agree to these Terms of Service. If you do not agree, do not use the Service.
PhotoBomb is a temporary photo messaging platform. Users send photos (“Drops”) that self-destruct after a single 5-second viewing. Drops can be sent immediately or scheduled for later delivery, and may be sent as a Surprise (with the sender's identity hidden until detonation) or to one or many recipients.
You must be at least 13 years old to use PhotoBomb. By using the Service, you represent that you meet this minimum age requirement and that you have the legal capacity to enter into these Terms.
You create an account using your mobile phone number and a one-time SMS verification code. By entering your mobile phone number, checking the consent checkbox, and tapping “Continue” in the PhotoBomb app, you consent to receive automated SMS messages from PhotoBomb related to:
These messages are transactional and user-initiated. PhotoBomb does not send marketing or promotional SMS messages. Message frequency varies based on user activity. Message and data rates may apply. You may reply STOP at any time to opt out, or reply HELP for assistance. For details on how the opt-in works, see our SMS Consent & Opt-In page.
You are solely responsible for the content you send through the Service. You agree not to use PhotoBomb to create, upload, send, share, or distribute any content that:
You also agree not to: (a) attempt to circumvent the self-destruct or one-view limits, including by automated capture; (b) use the Service to send unsolicited bulk messages to anyone who has not consented to receive them; (c) reverse-engineer, scrape, or otherwise abuse the Service; or (d) use the Service to harass any other PhotoBomb user.
Every user can report objectionable content and block abusive users directly from inside the app. To report a Drop, long-press the inbox item and choose “Report.” To block a sender, long-press the inbox item and choose “Block.” Blocked users can no longer send you Drops, and their identity will not appear in your inbox. You may also email support@photobomb.com to report abuse.
PhotoBomb has zero tolerance for objectionable content and abusive behavior. We will:

To protect users from spam and abuse, PhotoBomb enforces the following limits per account:
We may adjust these limits at any time without notice.
You may send a Drop as a Surprise (formerly Anonymous), in which case the recipient will not see your identity while the Drop is active. After the Drop self-destructs, your identity will be revealed to the recipient. Sender identity is always retained on our servers for safety and moderation purposes regardless of whether a Drop is sent as a Surprise.
When a recipient takes a screenshot during playback of your Drop, PhotoBomb will notify you. You acknowledge that screenshot detection is not foolproof — recipients can capture content using other devices, cameras, or methods that PhotoBomb cannot detect. Do not send any content you would not want to exist outside the app.
You retain ownership of the content you submit to PhotoBomb. By submitting content, you grant PhotoBomb a worldwide, non-exclusive, royalty-free license to host, store, transmit, and display that content solely as needed to operate the Service (including delivering Drops to recipients and showing previews to SMS recipients). This license terminates when the content is deleted under our retention policies described in our Privacy Policy.
We reserve the right to suspend or terminate any account that violates these Terms, with or without notice.
You may permanently delete your account at any time from inside the app: Profile → Account → Delete Account. Deletion removes your profile, sent and received Drops, contacts, circles, blocks, and reports. You may also email support@photobomb.com to request deletion.
PhotoBomb is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that media will be delivered without delay.
To the maximum extent permitted by law, PhotoBomb and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or relating to your use of the Service. Our total aggregate liability arising out of or relating to these Terms or the Service will not exceed one hundred U.S. dollars ($100).
You agree to indemnify and hold PhotoBomb and its operators harmless from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of (a) your use of the Service, (b) any content you submit, or (c) your violation of these Terms or any third-party right.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
We may update these Terms at any time. The “Effective Date” at the top of this page reflects the most recent changes. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
